<p><b>صفحهٔ تازه</b></p><div>'''ديه،''' مالي است كه در صورت وقوع جنايت بر نفس و يا كمتر از آن بر اعضاي بدن يا ايراد جرح، بايد ادا شود.<sup>1</sup> ديد بر وزن «عده» مأخوذ از «ودي» است.<sup>2</sup> در تاريخ و اقوام گذشته موارد زيادي از احكام صادره دربارۀ ديد وجود دارد؛ همانطور كه داوود پيامبر به ديه حكم ميكرد و قبل از آن نيز بين فرزندان ابراهيم بدان عمل ميشد.<sup>3</sup> در ترجمۀ مقاله دارست فرانسوي، دربارۀ حقوق اسلام آمده، پيش از اسلام مجازات قتل به وسيلۀ اولياي مقتول تا پنج نسل اجرا ميشد تا اين كه پرداخت خون بها (ديه) قرار داد متاركه بين خانوادهها امضاء شد.<sup>4</sup> در آن زمان قصد قاتل مورد توجه قرار نميگرفت و ميان جنايت عمد و خطا تفاوتي قائل نميشدند.<sup>5</sup> و دريافت عوض و مال، امري ناخوشايند به شمار ميآمد.<sup>6</sup> اما در اين عصر، قانون مجازات اسلامي، مجازات قتل عمد را قصاص ميداند و در صورت جنايت بر اعضاي بدن انجام عمل را دربارۀ جاني تأكيد ميكند.<sup>7</sup> و مادۀ 15 همين قانون چنين تعريف ميكند، ديد مالي است كه از طرف شارع، براي جنايت تعيين شده است.<sup>8</sup> خداوند در قرآن كريم، به صراحت از ديد نام برده و اين جزو نصوص قرآني است كه شك و شبههاي در آن راه ندارد و مخالفت با آن، مخالفت با قانون صريح خداوند ميباشد.<sup>9</sup> اما در عبارات فقها بر آنچه ديه واجب ميشود سه لفظ است، اول «ديه» كه بيشتر استعمال در جنايت ميباشد و گاهي در جنايت طرف يعني عضو نيز استعمال ميشود، دوم «ارش» اعم از آنكه شارع تقديري براي آن نموده باشد يا نه، سوم «خلافت» كه حكومت هم استعمال ميشود، و شارع تقديري در خصوص آن ننموده است.<sup>10</sup> <br />

ديه در متون فقهي، موضوع مشروح و مفصل كتابهاي فقهي است و داراي ابواب و فصول متعددي است و براي هر جزء از بدن انسان حكمي دارد.<sup>11</sup> فقهاي شيعه چون فقهاي ديگر مذاهب اسلامي ديۀ زن را در موارد قتل، نصف ديۀ مرد ميدانند.<sup>12</sup> موضوع احكام ديات در عصر حاضر از مشكلات دادگاه كيفري ميباشد، لذا از 1371 كتاب ديات كه در آن اقسام، مقادير و احكام ديات آمده، شروع به رونويسي شد.<sup>13</sup> علاوه بر آن كتابهاي بسياري پيرامون ديه نوشته شده از آن جمله شرايع از محقق حلي، 2- لمعه و شرح آن از شهيد اول و شهيد ثاني، 3- جواهرالكلام از صاحب جواهر، 4- تحريرالوسيله از امام خميني(ره)، 5- اجراي احكام جرايي (حدود قصاص ـ ديات) از كرماني، 6- مجموعۀ قوانين حقوق جرايي (ايران. قوانين و احكام)، 7- ديات ترجمۀ مسالك الافهام از محمد ابوالحسن، 8- قانون مجازات اسلامي (حدود، قصاص، ديات).<br />
