ديواني بود مسئول رسيدگي به اعمال ظالمانة حكام، امرا و رجال بزرگ دولت كه شخص پادشاه مسئوليت آن را بر عهده دارد. اولين كساني كه اين ديوان را برقرار كردند، خلفاي عباسي بودند و تا زمان مقتدر عباسي، شخص خليفه به آن ديوان رسيدگي ميكرد.<sup>1</sup> در تاريخ اسلام، براي حل مرافعات و اختلافاتي كه قضات از حل آنها باز ميماندند و يا مدعيان، قضاوت آنها را قبول نداشتند، هيأتي در نظر گرفته شده بود كه بر حكام ولايات، نظارت كرده و در حكم آنها، دخالت ميكرد؛ اين دادگاه به دادگاه اداري امروز شباهت دارد و تاريخچه و اساس تشكيل آن به جنگي كه خالد بن الوليد در آن، عدهاي از مردان بني جَذيمه را پس از تسليم به قتل رسانيد و علي بن ابيطالب(ع) از سوي پيامبر اسلام(ص) مأمور پرداخت دية مقتولين شدند، بر ميگردد. اين دادگاه، مسئول رسيدگي به تجاوز حكام بر رعايا، شكايت از مأمورين حقوق و اجرت، مراقبت از مأمورين وصول مالياتها و استرداد اموال غصب شده از سوي حكام به صاحبان آنها و نيز نظارت بر اجراي احكام است.<sup>2</sup> <br />
