در ؟ق / ؟م / 1289ش از سوي علماي نجف جزء پنج فقيهي انتخاب شد كه بر مصوبات مجلس نظارت داشتند. از دوره سوم تا ششم مجلس شوراي ملي وكيل بود. در دولت نظامالسلطنه (كابينه مهاجرت) مافي وزير عدليه بود كه با ناكامي اين دولت به عثماني رفت.<sup>2</sup> مدرس از مخالفان قرارداد 1919م وثوقالدوله و دولت كودتاي سيدضياء بود كه در كودتاي سياه به زندان افتاد و در دورة چهارم مجلس نايب رئيس بود. او كه در صدر مخالفان رضاخان در مسألة جمهوريخواهي و تغيير سلطنت بود به مجلس هفتم راه نيافت<sup>3</sup> و در 1307ش به دستور رضاشاه دستگير، به خواف و سپس كاشمر تبعيد شد و در آنجا به قتل رسيد (9 آذر 1316ش).<sup>4</sup> مدرس حامي پيوند دين و سياست بود و در مسائل ملي از حاميان و همفكران دكتر محمد مصدق به شمار ميرفت.<br />
