غصب از نظر ديني و شرعي حرام و موجب كيفر اخروي است<sup>4</sup> و از نظر فقه اسلامي و حقوق مدني ايران از موجبات «ضمان قهري» (مسئوليت مدني خارج از قرارداد در رديف اتلاف و تسبيب) است؛ يعني غاصب بايد عين مغصوب را (در صورت بقاء عين) با همان حالت و كيفيتي كه اول آن را غصب كرده است، به مالك يا صاحب حق برگرداند؛<sup>5</sup> و در صورت تلف عين مغصوب، در صورتي كه عين، «مثلي» (مانند گندم و جو) باشد، مثل مال تلف شده را و در صورتي كه «قيمي» (مانند سكه طلا) باشد، قيمت آن را به مالك اصلي تحويل دهد.<sup>6</sup><br />

در حقوق ايران، دعوي غصب به عنوان تقاضاي «خلع يد» در دادگاههاي حقوقي يا به عنوان تقاضاي «رفع تصرف عدواني» در دادسرا يا شوراي حل اختلاف، قابل طرح است. در دعاوي حقوقي، شاكي مدعي غصب و متقاضي «خلع يد»، بايد مالكيت خود را بر عين مغصوب ثابت كند و در پروندهاي «تصرف عدواني» مراجع قضايي بدون ورود به ماهيت واقعي مالكيت طرفين، به صرف احراز «سبق تصرف» شاكي به رفع «تصرف عدواني» عليه متصرف عدواني رأي ميدهد.<br />
