قصاص، اسم مصدر از ريشة «قصِّ يَقُصَّ» به معناي پيگيري نمودن اثر چيزي است.<sup>1</sup> قصاص از نظر لغوي، پيگيري و دنبال نمودن اثر جنايت است، به گونهاي كه قصاصكننده عين عمل جاني را نسبت به او انجام دهد.<sup>2</sup> قصاص در لغت فارسي به معني سزاي كار بد دادن است<sup>3</sup> كه با عناويني چون مجازات، عِقاب، تلافي، يا مقابله به مثل، برابري ميكند.<sup>4</sup> قصاص، استيفاء از جنايت است، خواه، آن جنايت قتل، ضرب و جرح يا نقص عضو باشد؛<sup>5</sup> يعني انجام دادن فعلي، همانند آنچه فاعل انجام داده است.<sup>6</sup> مادة 14 قانون مجازات اسلامي قصاص، چنين تعريف ميكند؛ قصاص كيفري است كه جاني، به آن محكوم ميشود و بايد با جنايت او برابر باشد.<sup>7</sup> قصاص، داراي دو وجه «حقاللهي» و «حقالناسي» است، كه اولين وجه، تكليف مجريان قانون و ديگري حق متضر، از جرم است و بر جنبة اوّل غلبه دارد.<sup>8</sup><br />

قصاص، ناظر به جرايم عمدي بدني و اجراي آن واجب است،<sup>10</sup> امّا به موجب مادة 257 قانون مجازات اسلامي، «قتل عمد» موجب قصاص است، ولي با رضايت ولّي دم و قاتل به مقدار ديه كامله يا كمتر يا بيشتر از آن، تبديل ميشود كه نظر بر جنبة حقالناسي قصاص دارد.<sup>11</sup> <br />
